Prevention of Sexual Harassment at Workplace is abbreviated as POSH. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 mandates organisations to protect their employees under this Act by forming an Internal Committee and appointing an External Member in the Committee. The Act also mandates conducting awareness sessions for all the employees.
Yes. Because, the Act protects any woman who visits your organisation. There’s a possibility of a female visitor/client being harassed hence, irrespective of the gender of your employees, you need to comply with the POSH Act if your employee count is more than 10.
Any person having the knowledge and relevant experience in the field of POSH can be an external member. However, we recommend empanelling someone with a legal background to avoid any legal complexities at a later stage.
Yes. All the employees must be sensitized on the provisions of the POSH Act.
It may lead to a penalty of INR 50,000 and exemplary damages and/or cancellation of business license/registration.
